The U.S. Department of Labor and the U.S. Citizenship and Immigration Service (USCIS) make provision for agricultural and non-agricultural temporary/seasonal work permits for foreign workers for up to ten (10) months. Certifications must be filed with USCIS for approval in the name of the employer. The time to process all of the necessary documentation is approximately 60 days.
Perspective employers must meet certain criteria in order to qualify for certification, including:
For farm laborers
- Provide housing with cooking facilities
- Provide workers' compensation insurance
- Pay AEWR wages
- Reimburse the cost of transportation
- Exempt foreign labor from withholding taxes
For custom harvesters
- Provide room and board
- Provide workers' compensation insurance
- Monthly/hourly AEWR wages
- Reimburse cost of transportation
- Exempt foreign labor from withholding taxes
