A New DOS Requirement is Causing Consulate Delays
In recent days, the Consulate has increased the number of cases placed into “Refused – Administrative Processing” (often referred to as a 221(g) refusal). In many instances, applicants receive a letter requesting additional documents before the visa can be issued. These requests are not being applied consistently. Some workers are receiving visas normally, while others on the same job order are being asked for more documentation. Additionally, the consulates are even erratically asking for driver related documents in cases where the job doesn’t involve commercial driving.
H-2A Alert: New USCIS Registration Requirement
The USCIS is now requiring certain foreign nationals to undergo a registration process and is requiring registered individuals over 18 to carry proof of their registration at all times. This requirement is related to President Trump’s executive order “Protecting the American People Against Invasion,” which he signed on January 20, 2025. Interestingly, this requirement is not new. It comes from a statute that has been on the books since 1952 but has rarely been enforced.
H-2A Alert: Update to Meal Charge/Travel Reimbursement Requirements
Every year, the U.S. Department of Labor (DOL) updates the maximum allowable meal charge and the minimum travel reimbursement rate. This morning, the DOL released the new, 2025 rates, which are set to go into effect on Monday, March 24, 2025. The new rate is $16.28/day.
