H2A Program for Agricultural Employers
The H2A program is the only legal non-immigrant temporary seasonal foreign worker visa program for U.S. agricultural employers. Workers may be employed up to ten months depending on the nature of the job that is to be of temporary seasonal work.
Agri Placements provides the administrative services for filing of the H2A documents with the State Workforce Agency (SWA), US Dept of Labor (DOL) and US Citizenship and Immigration Services (USCIS) for seasonal/temporary labor needs such as:
- General farm labor
- Hay, grain and wheat growers
- Custom harvesting
- Machinery operators
- Livestock & wildlife production
- Aquatic production
- Horticulture production
When To Apply
ETA 790 w/attachments must be filed with the SWA no less than 60 days and no more than 75 days prior to date of need. Once the SWA requirements have been satisfied, ETA 9142 together with ETA 790 and attachments must be submitted to US DOL no later than 45 days prior to the date of need. Therefore, Agri Placements recommends beginning the process no later than 3 months prior to the date of need. Emergency applications are possible meeting certain criteria.
